Welcome to Outlia. Please read these Terms of Use (“Terms”) carefully before using the Outlia website or mobile application (“Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not access or use the Service. We recommend saving or printing a copy of these Terms for your records.

 

1. Additional Applicable Terms

 

Your use of the Service is also governed by the following policies:

  • Privacy Policy: Outlines how we collect, process, and store your personal data.

  • Cookie Policy: Explains how we use cookies and tracking technologies.

  • Community Guidelines: Sets standards for acceptable content and interactions on the platform.

Feature-specific terms may apply if you use specialized tools or promotions. In the event of a conflict between these Terms and feature-specific terms, the feature-specific terms control.

2. Acceptable Use & Account Rules

  • Age Limit: You must be at least 13 years old to create an account or use the Service.

  • Individual Accounts: You may only create an account for yourself. Creating accounts on behalf of others is strictly prohibited unless you are explicitly authorized in writing to represent a business or employer.

  • Business Use: Commercial or business use requires prior express written consent from Outlia.

  • Account Security: You are responsible for all activity under your account. Keep your password confidential. If you suspect unauthorized access, contact us immediately.

  • Accurate Information: All details provided at registration must be true, current, and complete. You agree to update your information as needed to maintain accuracy.

  • Prohibited Content & Actions: You agree not to:

    • Post content that is violent, nude/partially nude, hateful, sexually explicit, discriminatory, or unlawful.

    • Defame, bully, harass, stalk, threaten, or impersonate any person or entity.

    • Post confidential or private information (e.g., credit card numbers, phone numbers, or email addresses).

    • Collect or solicit other members' login credentials.

    • Sell, transfer, license, or assign your account, followers, username, or rights.

    • Use domain names or web URLs in your username without written consent.

    • Send unsolicited commercial messages, comments, or promotional spam.

    • Use bots, scrapers, crawlers, or automated scripts to create accounts or access content without permission.

    • Inject code, viruses, malware, or alter how Outlia pages render in browsers or devices.

 

3. Intellectual Property & User Rights

 

Your Content

  • Ownership: You retain ownership of any text, photos, audio, video, GPX data, or other material (“Content”) you post to Outlia.

  • Licence Grant: By uploading Content, you grant Outlia a non-exclusive, royalty-free, transferable, sub-licensable, worldwide licence to use, display, distribute, and modify your Content across the Service, subject to our Privacy Policy.

  • Content Warranties: You represent and warrant that:

    1. You own or have licensed the necessary rights to all Content you share.

    2. Your Content does not infringe on third-party copyrights, trademarks, privacy rights, or intellectual property.

    3. You agree to pay all royalties, fees, or legal monies owed to any entity due to your posted Content.

 

Outlia Property

  • Outlia retains all rights, titles, and interests in Outlia Content, custom graphics, page headers, UI elements, branding, and proprietary software. You may not copy, modify, or exploit Outlia’s intellectual property without written permission.

 

Unsolicited Submissions

  • Outlia does not accept or consider unsolicited product ideas, features, or suggestions. If you choose to send us feedback or ideas, you grant Outlia permission to use them without restriction or compensation to you.

 

4. Service Availability & Content Storage

  • No Backup Guarantee: Outlia is not a backup service. Content may be temporarily unavailable due to routine maintenance, upgrades, or technical errors. Always maintain your own local backups of your media and trail data.

  • Content Removal: Outlia reserves the right to edit, block, or remove any Content at any time without prior notice.

 

5. Third-Party Links & Services

The Service may contain links, integrations, or embedded content from third-party platforms (e.g., mapping libraries, social tools, external websites).

  • Outlia does not endorse, control, or take responsibility for third-party websites or services.

  • If you connect your Outlia account to a third-party application, you acknowledge that information may be shared in accordance with that application’s settings, entirely at your own risk.

 

6. Liability & Disclaimers

 

Safety Warning: Trail content, member advice, and route descriptions provided on Outlia are for general informational purposes only. Outlia does not guarantee the safety, accuracy, or suitability of member-generated routes. Always exercise caution and independent judgment in the outdoors.

  • Service Disclaimer: Outlia is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not guarantee that the Service will be error-free, secure, or bug-free. You are responsible for your own device security and virus protection.

  • Limitation of Liability: To the maximum extent permitted by English law, Outlia shall not be liable for any direct, indirect, consequential, or incidental damages, loss of data, loss of goodwill, or business interruption arising out of your use of (or inability to use) the Service.

  • Statutory Rights: Nothing in these Terms excludes or limits our liability for death or personal injury resulting from negligence, fraud, or any liability that cannot be excluded by applicable law.

 

7. Account Termination & Enforcement

 

Breach of Terms

If we determine in our sole discretion that you have breached these Terms, we may take appropriate action, including:

  1. Issuing a formal warning.

  2. Temporary or permanent removal of posted Content.

  3. Temporary suspension or permanent termination of your account without notice.

  4. Legal proceedings to recover all administrative and legal costs resulting from the breach.

  5. Reporting illegal activities or data to law enforcement.

 

Deactivating Your Account

You can delete your account at any time via Profile Settings > Delete Profile.

  • Data Retention: Once deleted, your account will no longer be navigable. However, public comments, shared media, or Content re-shared by other users prior to deletion may persist on the Service.


8. Governing Law & Jurisdiction

  • Consumer Users: These Terms are governed by English Law. Courts of England and Wales will have exclusive jurisdiction. Residents of Scotland or Northern Ireland may also bring legal proceedings in their respective jurisdictions.

  • Business Users: These Terms and any non-contractual disputes are governed strictly by English law, subject to the exclusive jurisdiction of the courts of England and Wales.


9. Changes to Terms

We reserve the right to update or modify these Terms at any time. For significant updates, we will provide reasonable advance notice on the platform before the changes take effect. Continued use of the Service after effective dates constitutes acceptance of the revised Terms.
